  • UBUY CONSUMER ELECTRONICS AND APPLIANCE SERVICE CONTRACT TERMS AND CONDITIONS

    The Service Contract applies to parts and labor in respect of the product stated on the uBuy Service ContractCertificate for electrical and mechanical defects only and physical damage repairs if applicable.

    The Service Contract extends the warranty for the period stated on the Service ContractCertificate (the “Term”) commencing on the date of expiration of the manufacturers initial warranty period as stated on the manufacturer’s initial guarantee or from the date of purchase in the event Customer opted in physical damage repairs.

    How does this Programme work? (T&C)


    1. The Accidental and Extended warranties are based upon the Primary/Manufacturer's warranty.
    2. If you have a Manufacturer's warranty valid for a year or more you are eligible to buy/opt for the Accidental & Extended warranty programmes.
    3. In case the Manufacturer's warranty is missing or less than a year than to opt for the Accidental or Extended warranty programmes
        you need to buy the Primary/Extended warranty respectively, as applicable.
    4. The Accidental warranty programme will be active from the day of purchase of the product once opted.
    5. The Extended warranty will start once the Manufacturer's/Primary warranty ends.

    WHAT IS COVERED:

    Customers can get the product repaired from authorized service centers, free of cost to its normal operating condition after it has suffered a covered failure (due to a defect in material or workmanship) during normal use. The Service Contract covers the labor, parts and call-out charge necessary to repair the product subject to the exclusions listed below.

    uBuy Service Contract also covers food damage loss that results from a mechanical, electronic or electrical component failure of a refrigerator or freezer up to forty(40) KWDper claim during the Service Contract term.

    PRODUCT ELIGIBILITY:

    A uBuy Service Contract may only be purchased at the time of sale of a product and only covers a product which:

    1. Is purchased as new from one of uBuy Stores.
    2. Has included at the time of purchase a manufactures complete and original warranty.
    3. In the case of consumer products such as electronics and major appliances, the use is or has been limited to domestic and personal use. Office products such as facsimile machines and computers are covered for home and office use.

    IN THE EVENT OF BREAKDOWN:

    1. In order to be eligible under the Service Contract the customer must report the breakdown immediately after its occurrence.
    2. If the product is within the Service Contract term, contact the hotline number detailed on the Service ContractCertificate. Customers will receive instructions on how to proceed with the repair.
    3. Repairs must only be carried out by authorized service centers of relevant products.
    4. In-home service will be provided for all types of major appliances except for portable items (countertop microwave ovens, televisions under 42”, portable Hi-Fi systems, Home PCs, etc.) which should be brought into the authorized service centers of relevant products unless notified otherwise.
    5. The uBuy original store invoice must be presented for all repairs to the covered product.
    6. If the breakdown is not covered by the Service Contract, the customer will be charged for the cost of the repair.
    7. The customer should consult manufacturer’s instructions to determine if the failure to operate is due to circumstances that may be corrected.

    EXCLUSIONS FROM THE SERVICE CONTRACT:

    Primary & Extended Warranty

    1. Costs implicitly or explicitly covered by any manufacturers, suppliers or repairers guarantee or warranty.
    2. Non-operating and cosmetic damage such as damage to paintwork, product finish, dents or scratches, to the equipment and broken glass items.
    3. Accessories used in or with the product unless covered under a separate Service Contract. (For example, computer software, operating system, modem, scanner, printer, and charger).
    4. Replacement of any consumable item or accessory. These include, but are not limited to: plugs, fuses, batteries, light bulbs, light covers, cables, filters, attachments, belts, toner, ribbons, drums, tapes or software, add-on options incorporated in a product for which this contract was purchased.
    5. Normal wear and tear of items not integral to the functioning of the product.
    6. Routine maintenance, cleaning, lubrication, adjustments or alignments, overhaul, modification and de-scaling.
    7. Damage caused by unauthorized repair, theft, burglary, and accident including earthquake, storm and or hurricane, abuse, misuse, sand, water, negligence, fire, flood, lightning, malicious damage, war risks, impact, corrosion, battery leakage, acts of God, animal or insect infestation or intrusion.
    8. Damage resulting from power outage, power surges or dips, fluctuating voltage, or improper voltage or current.
    9. Reception or transmission problem resulting from external causes.
    10. Problems or defects not covered under manufacturer’s initial guarantee.
    11. Breakdowns caused by computer virus or realignments to products.
    12. Any item, which did not have manufacturer’s warranty at the time of purchase.
    13. Recalls or modifications to the product.
    14. Failure to follow the manufacturer’s instructions.
    15. The Serial Number/Model number of the set has been tampered with or removed.
    16. Costs arising from incorrect installation, modification or maintenance.
    17. Costs if no fault is found with the product.
    18. Commercial usage except product used in rental property, as identified in the Service ContractCertificate.

    Accidental Damage from Handling

    1. Costs implicitly or explicitly covered by any manufacturers, suppliers or repairers guarantee or warranty.
    2. Non-operating and cosmetic damage such as damage to paintwork, product finish, dents or scratches, to the equipment.
    3. Accessories used in or with the product unless covered under a separate Service Contract. (For example: computer software, operating system, modem, scanner, printer, and charger).
    4. Replacement of any consumable item or accessory. These include, but are not limited to: plugs, fuses, batteries, light bulbs, light covers, cables, filters, attachments, belts, toner, ribbons, drums, tapes or software, add-on options incorporated in a product for which this contract was purchased.
    5. Normal wear and tear of items not integral to the functioning of the product.
    6. Routine maintenance, cleaning, lubrication, adjustments or alignments, overhaul, modification and de-scaling.
    7.     9. Reception or transmission problem resulting from external causes.
    10. Breakdowns caused by computer virus or realignments to products.
    11. Any item, which did not have manufacturer’s warranty at the time of purchase.
    12. Recalls or modifications to the product.
    13. Failure to follow the manufacturer’s instructions.
    14. The Serial Number/Model number of the set has been tampered with or removed.
    15. Combined damages (For example: a screen crack combined with liquid associated damage or a multiple points of impact).
    16. Full liquid immersion.
    17. Damages occurred while device is left unattended or while not used for its intended purpose.
    18. Costs arising from incorrect installation, modification or maintenance.
    19. Costs if no fault is found with the product.
    20. Commercial usage except product used in rental property, as identified in the Service ContractCertificate.

    LIMITATION OF LIABILITY

    uBuy shall not be responsible for any loss or damage to a person or property, direct, consequential or incidental damages arising from the use of or inability to use the product to the extent that law may disclaim such. The Service Contract does not cover any defects which are subject to a manufacturer’s recall or which are covered under a manufacturer’s program or reimbursement.

    The Service Contract is only valid in the territory of GCC.

    Should necessary spare parts for repair be subject to import restrictions of a country resulting in delay in repairs, there will be no liability on uBuy arising out of such delay.

    In the event of theft, repossession, or fraud, or resale to another Party, the Service Contract will be cancelled by uBuy. Upon sale or transfer of ownership of the covered product, the Service Contract may be assigned to another Party by contacting the hotline number detailed on the Service ContractCertificate.

    uBuy is entitled, at its sole discretion, to replace the product with the same or similar product rather than to repair the product after applying fair use depreciation. The retail value of the replacement will not exceed the purchase price that was actually paid by the customer. Once a warranted product has been replaced, the customer’s cover under the Service Contract will end immediately with no refund. Following such settlement the original defective product will become the property of uBuy. Any amount unpaid pursuant to the terms of the Service Contract at the time of replacement shall become due and payable to uBuy.

    In the event that food is spoiled due to a covered breakdown of the product, uBuy will reimburse the Service Contract holder for such food spoilage up to a total of forty(40) KWDper incident provided the food spoilage has been verified and inspected within two (2) working days by the authorized repairer and properly documented.

    LIMITS OF LIABILITY

    1. Per Repair: uBuy liability for any one repair shall in no event exceed the retail price paid for the applicable Product or a model of a like functionality at the time of said repair.
    2. Aggregate: The total of all benefits paid or payable while this Certificate is in force in connection with any particular Product shall not exceed the retail price paid for such Product or a model of a like functionality.
    3. Maximum Number of Repair Visits: Unlimited for Extended Warranty & once for Accidental Damage from Handling & Primary Warranty.
    4. Basis of claim settlement:
      Extended Warranty
      Depreciation: 15% for year 1, 25% for year 2, 40% for year 3, 55% for year 4, 65% for year 5.
      Accidental Damage from Handling & Primary Warranty.
      Depreciation: 15% for the first 3 months, and an additional 5% on every month after, from date of purchase and up to maximum 80% during the Program period.
      Deductible: 10 KWD

    CANCELLATIONS

    Cancellation of the Service Contract may be made by the purchaser (customer) within seven (7) days of the Service Contract application date for any reason by mailing or delivering to uBuy an advance notice of cancellation and the original uBuy Service Contract Certificate if applicable. Any cancellation requested by the purchaser (customer) during this seven (7) day period will be refunded at 100%.

    uBuy may cancel the Service Contract by giving fourteen (14) days’ notice in writing to the customer’s last known address. uBuy will refund the purchaser (customer) an amount in respect of the remaining full months of warranty cover pro-rata to the original price of the cover.

    The Service Contract is offered by uBuy. uBuy reserves the right to vary, modify or otherwise amend the terms and conditions stated herein according to its sole discretion.

    What to do if your product breaks down:

    Customer must report the problem to us immediately and within one (1) day.

    1. Check the manufacturer’s instructions and make sure the controls are properly set.
    2. Ensure it is not something you can correct yourself, such as scaling, a blockage or blown fuse.
    3. Present the faulty Product to your nearest authorized repair center. The original purchase receipt & personal ID will be required to be included.
    4. The cost of dismantling the Product will be paid only in the event of a valid claim.
    5. The Customer should collect the Product from the service center after repair. Any labour/parts cost for repairs beyond the scope of this Certificate have to be borne by the Customer.

    Fraud: All benefits of the Service Contract are lost if a fraudulent declaration or claim is made.
